Copyright & trademarks
The Hidden Disabilities Sunflower Scheme Limited owns various trademarks covering the Sunflower logo design, lanyard design and associated marketing and designs. Organisations that have adopted the scheme, including all major airports, rail companies, NHS, supermarkets etc. are required to buy the official products from The Hidden Disabilities Sunflower Scheme Limited to become part of the Scheme. The official Sunflower design is now widely recognised and are subject to copyright and trademark protection.
Unfortunately, there are some organisations who are clearly trying to copy the design and sell unofficial (and inaccurate) copies of our Lanyards. This is misleading to the organisations, the general public and users of the lanyards and potentially exposes wearers to difficulties within organisations where the supporting staff may not have the appropriate knowledge or training to cater for the needs of people with Hidden Disabilities.
The Hidden Disabilities Sunflower Scheme Limited will consider applications from organisations that want to use the official logo on workwear or within advertising and will do so under a appropriate licence agreement. Please contact us for further information if you wish to use the design.
The scheme, logo, design combined with the term ‘Hidden Disabilities’ are protected under a UK Trademark. Please see section 4 for further details.
1. Liability

- Where Services are distance learning products then the Client shall abide by all reasonable terms of any licence agreement applicable.
- Intellectual Property which is identified as, or can reasonably be deemed to be, confidential shall not be copied or reproduced or disclosed to any third party without the prior written consent of Hidden Disabilities Sunflower Scheme Limited. The Client shall ensure that its employees and all those under the Client’s control and supervision comply with this obligation.
- Where Services are provided to the specification or special requirements of the Client, the Client shall indemnify Hidden Disabilities Sunflower Scheme Limited against all costs, claims and damages incurred or arising out of any alleged infringements of Intellectual Property.

We will act appropriately when we identify activity that constitutes a primary infringement of any of these trademarks. Unauthorised use in relation to identical or similar goods or services to those for which our trademarks are registered will result in the likelihood of confusion on the part of the public and therefore you will infringe our trade mark under section 10(2) of the Trade Marks Act 1994. Furthermore, our trademark has a global reputation and we are of the view that any unauthorised use will take an unfair advantage of and will be detrimental to the distinctive character of our trademarks.
